Mr. Marker is a pro-tem Judge, attorney, and mediator. He has more than twenty years of experience in deciding cases and helping parties reach a resolution to their disputes. Mr. Marker provides arbitration services or services in which parties may want a quasi-judicial opinions on their matter or dispute.
In arbitration, or the private judge service, the parties will enter into a negotiate contract that outlines the role the parties would like Mr. Marker to play in the decision making process.
The parties may agree to have Mr. Marker's decision be binding, meaning they are agreeing to be bound to that decision in lieu of a court decision. The parties can also agree that the decision is non-biding or only an opinion on how the matter could be decided.
Non-binding opinions can be very valuable in that you have an idea how the court might decide after hearing all the evidence. The ability to hear how the court might potentially decide your case allows the parties to explore different ways to reach a settlement instead of going to trial.
Mr. Marker can provide a binding or non-binding opinion and remain the neutral who then helps the parties mediate or negotiate their settlement.
